СЛЕДСТВЕННЫХ ДЕЙСТВИЙ НА СТАДИИ ВОЗБУЖДЕНИЯ УГОЛОВНОГО ДЕЛА
Аннотация. В статье анализируются вопросы квалификации внесения
недостоверных сведений в протоколы следственных действий, проводимых до
возбуждения уголовного дела. Приводится несколько ситуаций, которые могут быть
оценены по-разному. В случаях, когда должностное лицо, фальсифицируя
доказательства в ходе доследственной проверки, в дальнейшем приобщает их к
материалам уголовного дела, в его действиях присутствует состав преступления,
предусмотренного ч. 2 или ч. 3 ст. 303 УК РФ. Если должностное лицо подделывает
протоколы следственных действий с целью отказа в возбуждении уголовного дела,
то содеянное надлежит оценивать по ст. 286 УК РФ. В ситуации, когда следователь
или дознаватель, осведомленный о фальсификации доказательств на стадии
возбуждения уголовного дела, использует эти документы в процессе
предварительного расследования, его действия могут квалифицироваться в
зависимости от направленности умысла по ст. 285 УК РФ, ч. 1 или ч. 2 ст. 299 УК
РФ, ст. 300 УК РФ.

PROBLEMS OF LEGAL ASSESSMENT OF FALSIFICATION OF PROTOCOLS
OF INVESTIGATIVE ACTIONS AT THE STAGE OF INITIATION OF A
CRIMINAL CASE
Abstract. The article analyzes the issues of qualification of entering false information
into the protocols of investigative actions conducted before the initiation of a criminal
case. Several situations are presented that can be evaluated in different ways. In cases
where an official, falsifying evidence during a pre-investigation check, furtherly
attaches them to the materials of the criminal case, his actions contain the corpus
delicti provided for in Part 2 or Part 3 of Article 303 of the Criminal Code of the
Russian Federation. If an official falsifies the protocols of investigative actions in
order to refuse to initiate a criminal case, then the act should be assessed under
Article 286 of the Criminal Code of the Russian Federation. In a situation where an
investigator or inquirer, who is aware of the falsification of evidence at the stage of
initiating a criminal case, uses these documents in the course of a preliminary
investigation, his actions may be qualified depending on the direction of intent under
Article 285 of the Criminal Code, Part 1 or Part 2 of Article 299 of the Criminal
Code, Article 300 of the Criminal Code.
